Q.    If I am injured on the job, do I have to go to the company’s  doctor?

A.    Wisconsin law says that, when you are injured on the job, you are allowed to choose your own doctor for any treatment. In fact, you have two choices - if you wish to be treated by a second doctor, you simply inform the company in writing that you are seeing a second doctor, and go to the second doctor.

Of course, if your first doctor refers you to another doctor that is not a second choice, nor is it a second choice if you see more that one doctor in the same clinic.

So the company, except in an emergency, cannot require you to be treated by their doctor. However, the company does have the right to send you to a doctor of their choosing for evaluation only. Can they send you to more than one? That depends on whether they have a good reason. How often can they send you for evaluation? That too depends on what their reason is.

The real answers are different in each case. If you have been asked to see the company’s doctor, it’s probably a good idea to get the advice of a lawyer experienced in worker’s compensation.  Such lawyers do not charge for that advice, and the answer could have a large impact on your case.
